While riding with the Captain, after Nolan re-holsters his weapon, the suspicious van turns right. The van can then be seen behind them through the rear window, and in the subsequent shot a reflection of the van can be seen in the windows across the road.

Nolan is sitting in the line of fire and a readily available target. The chances of Cole hitting the Captain is next to none while the chances of hitting Nolan is much more probable.

Nolan makes a huge tactical error when the gun thug is firing at him with the full-auto weapon. He has cover behind his truck and the thug is focused on firing into the passenger area. He should have pulled, and returned fire from one side of the truck or the other.
