John Sauer, a lawyer arguing Donald Trump’s presidential immunity case, generated significant controversy when he asserted, in response to a judge’s hypothetical, that a president could not be prosecuted if he were to order the assassination of a political rival — unless he were first impeached and convicted.
With that case now before the Supreme Court, Sauer is arguing that justices should not be concerned with “lurid hypotheticals” that “almost certainly never will occur, and would virtually certainly result in impeachment and Senate conviction … if they did occur.”

Donald Trump — the man most responsible for triggering the end of a federal right to abortion — announced Monday that if he wins the presidential election in November, he does not plan to support further federal restrictions on the practice and would allow it to remain a state issue.
“My view is now that we have abortion where everybody wanted it from a legal standpoint,” Trump began. (The word “everybody” is being used liberally here: Roughly two-thirds of voters disapprove of the Supreme Court’s decision overruling Roe v. Wade, according to a recent survey.

The Supreme Court heard arguments on Thursday pertaining to whether states can throw Donald Trump off the 2024 presidential ballots if they determine he violated the 14th Amendment — which essentially disqualifies insurrectionists from holding office. The former president shouldn’t be too worried, however, as the conservative-controlled court seems unlikely to permit what Chief Justice John Roberts described as a “pretty daunting consequence.”
The justices did not seem very concerned with the question of whether Trump is actually an insurrectionist, only addressing it briefly during the proceedings. Trump lawyer Jonathan Mitchell...

The Supreme Court heard arguments on Thursday in the case over whether states can toss Donald Trump off their ballots. Much of the discussion centered around a wildly inane legal question: whether America’s president qualifies as “an officer of the United States.”
The case will review Colorado’s decision to disqualify Trump from its ballot on the grounds that he committed “insurrection” by inciting the violent assault on the U.S. Capitol on Jan. 6, 2021, as lawmakers were preparing to certify President Joe Biden’s electoral victory.
At issue is Section 3 of the 14th Amendment,...

Update: Donald Trump said that he “thought that our arguments” were very strong before the Supreme Court, as he held a press conference shortly after oral arguments ended.
He called it a “beautiful process,” clearly pleased with legal analysts’ predictions that the justices were likely to rule in his favor on the question of whether Colorado could exclude him from the state ballot.
The major cable news networks carried the speech, but CNN and MSNBC broke away as he veered into campaign rhetoric.
“I am leaving it up to the Supreme Court,” Trump said.
Previously: As the Supreme Court heard arguments on whether Donald Trump can be kept off the state ballot, there were signs that the justices have skepticism about such a move.
