The producers of the Alec Baldwin film “Rust” are nine months late in paying the widower and son of cinematographer Halyna Hutchins, who was killed in a gun accident on set in 2021, according to a recent court filing.
Baldwin and the other producers announced a settlement of the family’s wrongful death lawsuit in October 2022. The terms, finalized in March 2023, provided for completion of “Rust” and payments to the Hutchins estate, including insurance funds and a portion of the profits.
Rust Movie Productions LLC was supposed to make the full guaranteed payments by June 13, 2023, according to a Feb. 7 filing from the estate’s attorneys.
But that has not happened, according to the filing. The estate is now considering its options, which include resuming the wrongful death lawsuit or filing a new one.

The producers of Rust have settled a citation from a New Mexico safety agency for numerous violations of safety protocols on the set of the low-budget western.
The New Mexico Occupational Health and Safety Bureau found in April that the movie’s producers knew that firearm safety procedures weren’t being followed on-set and demonstrated a “plain indifference’ to the welfare of cast and crew by failing to train crew on how to properly handle firearms and introducing live ammunition onto the set, among other things. It issued the highest level citation and maximum fine allowed by state law of $136,793.
Under the settlement announced on Friday, which has to be approved, the citation is downgraded from a “willful-serious” violation to “serious.” The production will pay a reduced civil penalty of $100,000.

A New Mexico prosecutor will announce a decision on Thursday over whether to file criminal charges against Alec Baldwin and others for their roles in the fatal shooting on the set of Rust in October 2021.
Mary Carmack-Altwies, the First Judicial District Attorney, and a special prosecutor brought on to handle the case will announce their decision in a written statement at 9 a.m. Mountain Time, according to a statement from the office.

The prop master on Rust is looking to be dismissed as a defendant in Alec Baldwin’s countersuit involving the fatal shooting of Dp Halyna Hutchins on the set last year.
In court papers filed with Judge Michael E. Whitaker on Thursday, lawyers for Sarah Zachry maintain that their client is a New Mexico resident since birth and is not subject to the personal jurisdiction of the California courts.
“Zachry has never been a resident of California, nor has she ever lived or worked in California,” her lawyers state in their court papers. “Ms. Zachary has not traveled to California for any purpose related to her hiring or work on the `Rust’ production. The last time that Ms. Zachary visited California was in 2019 and she has not returned to the state at any time since then.”

A year after cinematographer Halyna Hutchins was killed in a shooting on the set of Rust, her family has settled a wrongful death suit with the production. The plan from the settlement is to resume shooting in January with her husband, Matthew Hutchins, as an executive producer.
“I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin),” Hutchins said in a statement. “All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work.”

Updated: Alec Baldwin’s Attorney Luke Nikas of Quinn Emanuel has responded to the recent news from Santa Fe District Attorney Mary Carmack-Altwies, who in a Aug. 30 letter, requested the New Mexico Board of Finance for 635K to prosecute as many as four individuals with criminal and homicide charges.

A Los Angeles judge has dismissed the primary claims of assault and intentional infliction of emotional distress against the producers of “Rust” in a civil lawsuit from the film’s script supervisor, Mamie Mitchell.
In a hearing on Friday via multiple media reports, a judge tossed both of the main claims against Rust Movie Productions, Thomasville Pictures, Ryan Smith and Langley Cheney, writing that it was not possible for them to know that Alec Baldwin would shoot the gun that killed cinematographer Halyna Hutchins.

Nearly 10 months after Alec Baldwin killed Rust cinematographer Halyna Hutchins on the New Mexico set of the low-budget Western, the police investigation into what happened remains ongoing but is a bit closer to completion.
Santa Fe County Sheriff’s investigators say that they received the FBI’s completed forensic reports August 2, which were then sent to New Mexico Office of the Medical Investigator for review. “The Omi had advised the Sheriff’s Office that they required these forensic reports to finalize their investigation,” reads a release from the Sheriff’s Office, which received the reports Wednesday.
