- In 1940 he was arrested for stabbing his accountant in the groin following a heated argument. In the aftermath of the attack the accountant had to have a leg amputated and Fancey received a short prison sentence in 1941.
- For a time he lived with his wife B.C. Fancey and also moved his mistress Olive Negus-Fancey into the family home. He eventually had two different families and most of his children followed their father into the film business. Malcolm Fancey and Adrienne Scott are the children he had with B.C. Fancey while Judith Smith and Charles Negus-Fancey are the children he had with Olive Negus.
